Clearinghouse Compliance Checklist:
- Register with the FMCSA Clearinghouse (www.clearinghouse.fmcsa.dot.gov)
- Designate Tenstreet as your TPA
- Make sure you have purchased a query plan in the Clearinghouse
- Understand your obligations:
- Pre-hire : employer must conduct a full query showing driver is not prohibited
- Electronic consent given by the driver directly to the Clearinghouse to release information
- Annually: employer must conduct limited query annually for all current employees
- Written consent for limited query signed by driver outside of the Clearinghouse (can be electronic)
- If limited query shows the presence of information in the Clearinghouse, full query must be conducted within 24 hours

- Implement a Limited Query Consent on the signature portion of your Intelliapp:
- Get it signed by all your current drivers and all your new hires so you’re ready when its time to conduct the annual limited query
- Save the limited query consent in the DQF
- Make sure you retain all results from the Clearinghouse in the DQF
- Update your list of consumer reporting agencies for the 1681m Notice and California disclosure to include the FMCSA Clearinghouse contact information
- Add the FMCSA Clearinghouse contact information and the Clearinghouse results to your adverse action letters
- Make sure your employee drug and alcohol policies and training include the Clearinghouse information to comply with 49 CFR 382.601 obligations
